Hernandez's lawyers request footage of search at home

Posted: Updated:
NORTH ATTLEBORO, Mass. (WHDH) - Aaron Hernandez is due back in court Tuesday for the third week in a row.

He will appear for a hearing in Boston, connected to charges against him in a 2012 South End double murder. The hearing is procedural, for setting dates for future court appearances.

His attorneys continued their push Monday to get evidence thrown out in his case in Bristol County. The defense team is asking a judge to issue a subpoena to local news outlets, including 7News. Attorneys want photos and videos taken at Hernandez's home. They argue the video could disprove a state trooper's testimony about a warrant served during a search of Hernandez's home about a week before his arrest.

In our video, you can see two investigators walking into the house. One man appears to have paperwork in his left hand as he goes in the front door. It's not clear if this is the exact moment that search warrant was served.

A state trooper testified last week that he was carrying the search warrant when he went to Hernandez's home. The defense argues if the video contradicts the testimony given by the trooper, they should be able to suppress evidence seized from the home that night.

A judge has not yet ruled on this motion.
