Hernandez lawyers challenge Odin Lloyd murder charge

Fall River, Mass. (WHDH) -

In Bristol Country District Court Monday, lawyers for Aaron Hernandez filed several motions regarding his trial in the death of Odin Lloyd.

Lawyers asked the judge to dismiss the murder charge in the 2013 death of Odin Lloyd. They said the prosecution had no evidence against Hernandez and was using smear tactics.

“The commonwealth basically took a whole bunch of stuff which was intended to besmirch Mr. Hernandez’s behavior,” defense attorney James Sultan said.

The prosecution argued that what happened between Hernandez and Lloyd matched a pattern.

“There were remarkable similarities between what happened to Alexander Bradley and what happened to Odin Lloyd,” prosecuting attorney William McCauley said.

Also in court, Hernandez’s defense team asked the judge to subpoena medical and psychological records from the Patriots.

“Certainly they were put on noticed of the of the process that would unfold if they did not respond to our release that we delivered in July of 2013 and our follow up phone calls and correspondence in the fall of 2013 to which we received no response,” defense attorney Michael Fee said.
“There’s silence, we’ve been ignored.”

Judge Susan Garsh said she may send this matter to another judge because of her personal friendship with one of the Patriots’ lawyers.

Hernandez also faced two new charges in court Monday, one charged for allegedly assaulting a fellow inmate and one for allegedly threatening a guard. Hernandez pleaded not guilty to both.
