Mother of Jeremiah Oliver has hearing delayed

WORCESTER, Mass. (WHDH) - The mother of Jeremiah Oliver was scheduled to face a judge Monday for the first time since her son's body was found, but that hearing has been delayed.

Elsa Oliver, 28, pleaded not guilty to charges including kidnapping and assault and battery in connection with the death of five-year-old Jeremiah Oliver from Fitchburg.

Family members were distraught inside Worcester Superior Court following a brief hearing, with Jeremiah's uncle screaming outside the court room.

"I'm just grieving right now. Just seeing my brother grieving. It hurts to see him like that. He was very close to Jeremiah," said Jose Oliver, the victim's father.

The mother did not attend the hearing.

"Ms. Oliver remains substantially unable to participate in her defense. I continue to be unable to have any significant, meaningful conversations with her," said Attorney Gavin Reardon.

Oliver's boyfriend Alberto Sierra was also charged in connection with the disappearance and remains behind bars. Nobody has been charged with the death but an investigation is still ongoing.

"It is certainly a possibility, within the realm of possibility that murder charges will be coming down the road. But at this point, I really don't know," Reardon said.

Jeremiah was under the supervision of the state’s child protection agency when he disappeared. He was missing for months before his body was finally found last week off Route 190 in Sterling.

His funeral has been scheduled for Saturday in Fitchburg.
