Eligibility:
The BLUE MAN GROUP CONTEST (“Promotion”) is open only to WHDH viewers (residing within Massachusetts, Rhode Island, New Hampshire, Vermont, Maine and Connecticut) and who are eighteen (21) years of age or older. Employees of WHDH-TV, Sunbeam Television, advertising and promotion agencies involved with this Promotion and the immediate family members and/or those living in the same household of such employees, are not eligible to participate. By entering this Promotion, participants consent to be bound by these rules (the “Official Rules”). All federal, state and local laws and regulations apply.
2. Sponsors/Administrator:
The Sponsors of the Promotion are WHDH-TV, Sunbeam Television.
3. Promotion Period: March 30 – April 26, 2015.
4. Promotion Description & Prize Description: To enter, viewers must text the word ‘BLUE’ for a chance to win the Grand Prize. No purchase necessary.
PRIZE: There will be one (1) Prize (Prize) awarded. Prize winner will receive 2 tickets to see The Tonight Show in New York City, including hotel and transportation, plus 2 tickets to see Blue Man Group at the Charles Playhouse in Boston. If Winner elects to partake in any or all portions of his/her Prize with fewer than three (1) guest or no Guest, the Prize will be awarded to Winner and each participating Guest and any remainder of the Prize will be forfeited and shall not be subject to further or alternative compensation. All elements of the Prize must be redeemed at the same time, and no changes will be permitted after confirmation of any redemption. Winner must be at least twenty-one (21) years of age in order to check into the on-site hotel. Specific travel dates and arrangements are subject to holiday, blackout dates, and other prize and travel restrictions. ARV of Prize may vary depending upon hotel rate fluctuations; the ARV of Prize will not be awarded. Prize consists only of the elements expressly set forth above; no other elements or expenses (including, without limitation, insurance, meals, unspecified ground transportation, phone calls, gratuities, incidentals, souvenirs, gasoline, etc.) are included in the Prize and all such expenses are the sole responsibility of Winner. Winner is responsible for any travel taxes and/or expenses, including gasoline, tolls and other automobile expenses. Once issued, reservations are nontransferable and may not be reissued once travel has commenced. Hotel arrangements must be made through Prize Providers. All Prize elements must be redeemed at the same time.
All eligible entries received by 12:01AM Eastern Standard Time (EST) April 26, 2015 will be entered into a random drawing to win the prize described above.
5. Conditions for Participation and Validation of Entries:
Entries must be made via twitter as specified above. Entries generated by a script, macro, robotic or other automated means will be disqualified. You may enter only once per each household, systems permitting, however, USE OF COMPUTER PROGRAMS TO ENTER AND/OR OTHER AUTOMATIC ENTRY METHODS, (SUCH AS HACKS OR BOTS), REGARDLESS OF METHOD OF ENTRY IS STRICTLY PROHIBITED. Sponsors reserve the right to disqualify and block or discard entries from any individual who enters by any kind of electronic, mechanical or other automated means or otherwise tampers with or hacks the entry process as determined by the Sponsors in their sole discretion. Sponsors also reserve the right, in their sole discretion, to cancel, modify or suspend the Internet, electronic and/or text-messaging portions of the Promotion in the event of a computer virus, bugs, tampering, unauthorized intervention, fraud, technical or system failure or disruption, force majeure or any other causes which, in their sole opinion, corrupt the administration, security, fairness, integrity, or proper operation of the Promotion. CAUTION: ANY ATTEMPT TO BAN AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. THIS IS OUTLINED MORE CLEARLY BELOW. Sponsor is not responsible for late, lost and/or incomplete entries, which will be disqualified.
6. Random Drawings:
All eligible entries received by 12:01AM EST April 26, 2015 have the opportunity to have their name chosen at random. No purchase necessary.
7. Winner Notification:
Winner will be notified by phone or e-mail. If the winner cannot be reached, the winner (as applicable) will forfeit the prize, and a second contestant’s name will be selected at random to receive the prize. Odds of winning the prize depends on number of eligible entries received during the entry period.
8. General Conditions:
a. Entrants fully and unconditionally agree and accept to be bound by the Official Rules and the decisions of Sponsors, which shall be final. Sponsors have the right to modify these rules in their sole discretion for clarification purposes without materially affecting the terms and conditions of the Promotion.
b. Except where prohibited, all winners grant to Sponsors and their advertising agencies the right to use, and publish his or her proper name on the WHDH.com website without additional compensation.
c. Entrants enter at their own risk. Sponsors and Prize Providers are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incorrect, incomplete, ineligible or unintelligible entries; (ii) telephone, electronic, hardware, software program, network, Internet or computer failures or difficulties; (iii) errors in transmission; (iv) any condition caused by events beyond the control of Sponsors or prize providers that may cause the Promotion to be corrupted; (v) any injuries, losses, or damages of any kind caused by a prize or resulting from acceptance, possession, use or misuse of participation in the Promotion; or (vi) any printing or typographical error in any materials associated with these Official Rules or the Promotion generally. Entrants assume all liability for any injury or damages caused or claimed to be caused by his or her participation in the Promotion and/or the acceptance and/or use of any prize, and release Sponsors, Prize Provider and their respective officers, directors, employees, parents, subsidiaries and affiliates from any such liability. Sponsors, prize providers and their respective officers, directors, employees, parents, subsidiaries and affiliates assume no responsibility for any injury or participants or any other person’s computer relating to or resulting from entering or downloading materials or software in connection with this Promotion. PLEASE NOTE THAT A HIGH VOLUME OF ENTRIES, OR TECHNICAL DIFFICULTIES WITH THE SYSTEM, MAY RESULT IN TEMPORARY INABILITY TO ENTER THE GAME OR A DELAY IN THE PROCESSING OF ENTRIES SUCH THAT YOUR ENTRY IS NOT RECEIVED IN TIME TO PARTICIPATE. SPONSORS AND PRIZE PROVIDERS ARE NOT RESPONSIBLE OR LIABLE SHOULD ANY ENTRY NOT BE RECEIVED DUE TO SUCH DELAYS.
d. Sponsors and prize providers may prohibit any entrant or potential entrant from participating in the Promotion, if at the sole discretion of Sponsors or prize providers, such person shows a disregard for these Official Rules, or acts (1) with an intent to annoy, abuse, threaten, or harass any other entrant, Sponsors, prize providers or their agents or representatives; or (2) in any other disruptive manner.
e. In the event of a dispute as to the identity of an entrant entering via the methods set forth above in section #4 above, the authorized account holder of the email address used to enter, if applicable, will be deemed to be the entrant. “Authorized account holder” of an email address is defined as the natural person who is assigned to an email address by an Internet Access provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
f. All issues and questions concerning the construction, validity, interpretation and enforceability of Official Rules, or the rights and obligations of the participant and Sponsors or prize providers in connection with the Promotion, shall be governed by and construed in accordance with the laws of Massachusetts without giving effect to any choice of law or conflict of law rules or provisions which would cause the application of the laws of any jurisdiction other than the State of Massachusetts. Sponsors’ decisions as to all matters related to the administration of the Promotion and selection of the Grand Prize winner is final.
