WORCESTER, Mass. (WHDH) - The mother of the missing 5-year-old from Fitchburg and her boyfriend were indicted by a grand jury Friday on charges related to the boy's disappearance.

Officials are now calling it a homicide investigation.

Elsa Oliver, 28, is being charged with permitting bodily injury to a child, three counts of reckless endangerment, kidnapping, assault and battery with a dangerous weapon and three counts of assault and battery.

Alberto Sierra, 23, was indicted for indecent assault and battery, permitting bodily injury, three counts of reckless endangerment, kidnapping, four counts of assault and battery with a dangerous weapon and two counts of assault and battery.

Jeremiah Oliver was reported missing on Dec. 13, but has been missing since September.

His mother is being held on $100,000 cash bail after being charged in Fitchburg. Sierra is being held without bail.

The cases have now been moved from Fitchburg District Court to Worcester Superior Court.

Three members of the DCF have been fired as a result of the case, which highlighted some problems in the department.
