PROVIDENCE, R.I. (AP) — Two former top executives at Rhode Island's economic development agency want immunity from liability over its failed $75 million investment in Curt Schilling's video game company because they say they were public officials who were just doing their jobs.

Lawyers for former Economic Development Corp. Executive Director Keith Stokes and Deputy Director Michael Saul told a judge Tuesday that the two were following orders from superiors and should be protected by "public duty immunity."

The EDC sued its own former officials and 38 Studios executives, saying they misled the board into approving the loan guarantee.

A lawyer for Schilling on Tuesday argued the judge should dismiss the lawsuit against all the 38 Studios executives named in it.

38 Studios went bankrupt last year, leaving the state on the hook for some $100 million.
