Schilling lawyer to argue for tossing lawsuit

Posted: Updated:

PROVIDENCE, R.I. (AP) -- Lawyers for Curt Schilling and architects of a state deal to give his now-bankrupt video game company a $75 million loan guarantee are set to argue for the dismissal of a lawsuit filed against them by Rhode Island's economic development agency.

The first of two days of arguments before Superior Court Judge Michael Silverstein is scheduled for Wednesday.

The state Economic Development Corp. says there's "crushing evidence" the former Boston Red Sox pitcher and others concealed financial information about 38 Studios before the agency board approved the loan guarantee. Schilling and others being sued say they repeatedly disclosed the company's financial needs.

38 Studios went bankrupt last year, leaving the state on the hook for some $100 million related to the deal.

Schilling has called the suit political.
